Terms of Service

These terms govern your use of the Watchful website, our customer account area, service enquiries, and purchases made through the public shop.

1. Acceptance of these terms

By using this website, contacting Watchful, creating an account, or placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the site or submit personal information through it.

2. About Watchful

Watchful is a division of iCatch Private Investigators and operates in South Africa. Certain services described on this site, including investigations, intelligence, surveillance-related work, and protection services, are subject to operational, legal, licensing, and case-specific limitations.

3. Website use and acceptable conduct

You may use this website only for lawful purposes. You may not misuse the site, interfere with its normal operation, attempt unauthorised access, submit false information, impersonate another person, or use our services, products, or information to support unlawful surveillance, harassment, fraud, or any other illegal activity.

4. Service enquiries and investigations

Submitting an enquiry does not create a binding service contract. Quotes, timelines, scope, and availability are confirmed separately after we review the request. Investigative and security outcomes depend on facts, legal limits, access, timing, and third-party cooperation, so specific results cannot be guaranteed.

5. Customer accounts

You are responsible for keeping your account credentials confidential and for the activity that occurs under your account. You must provide accurate information and update it when it changes. We may suspend or restrict access if we reasonably believe an account is being misused or used unlawfully.

6. Shop orders, pricing, and availability

Product listings, pricing, availability, and specifications may change without notice. An order is not finally accepted until we have successfully processed it and issued confirmation through our normal checkout flow. If stock, pricing, or technical issues affect an order, we may need to contact you to correct, delay, or cancel the order.

7. Payment terms

The website currently supports EFT and, where enabled, PayPal. You must use a payment method you are authorised to use. PayPal transactions are also subject to PayPal's own terms. Orders may remain pending until payment is confirmed through the relevant channel.

8. Delivery, collection, and fulfilment

Delivery and collection arrangements are handled according to the option selected during checkout and any follow-up communication from our team. Delivery estimates are good-faith estimates, not guarantees. Risk and fulfilment timing may depend on stock availability, courier performance, payment clearance, and your accuracy when providing contact and address details.

9. Returns, faults, and customer support

If you believe a product is faulty, incorrect, or incomplete, contact us promptly through the support or contact channels on the site. Any return, replacement, repair, refund, or cancellation rights are subject to the facts of the transaction and any rights that apply under South African law.

10. Intellectual property

All website content, branding, copy, graphics, layouts, and materials on this site remain the property of Watchful, iCatch Private Investigators, or their licensors unless stated otherwise. You may not copy, republish, distribute, or commercially exploit site content without prior written permission.

11. Disclaimer and limitation of liability

This website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not warrant uninterrupted access, error-free operation, or that the site will always be free of harmful components. We are not liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the site, reliance on its content, service delays, or third-party systems beyond our reasonable control.

Nothing in these terms excludes liability that cannot lawfully be excluded under applicable law.

12. Third-party services and links

This site may contain links to third-party services or websites. Those services operate under their own terms and policies, and we are not responsible for their content, availability, or handling of your information.

13. Changes to these terms

We may update these Terms of Service from time to time. The latest version published on this page applies from the updated date shown below.

14. Governing law

These terms are governed by the laws of South Africa. Any dispute relating to the site, services, or shop will be handled in the appropriate South African forum, subject to any non-excludable rights you may have under applicable law.

15. Contact
